The Right to an Inspection: How One Inspector Helped Change the Law in Massachusetts

What started as concern for clients turned into a statewide legislative victory for consumer protection.

Why the Law Was Needed

During a hot housing market, buyers were often pressured to waive home inspections just to get their offers accepted. This led to financially devastating surprises for new homeowners and a collapse in demand for professional inspectors.

How the Bill Took Shape

Atwell contacted his state rep, gathered a team of ASHI leaders and affiliates, and they hired a skilled lobbyist and attorney. The result? A compelling, enforceable law that makes waiving an inspection a violation and mandates full disclosure of a buyer’s inspection rights.

Overcoming Opposition

Real estate lobbying groups attempted to block the bill with misinformation. But the Massachusetts ASHI Home Inspector team countered with data, personal stories, and powerful testimony. Their efforts paid off—the bill passed unanimously in the Senate and is now law.

What This Means for Inspectors and Consumers

Buyers now have legal protection and informed consent. Home inspectors see more stable business opportunities. It’s a win for everyone, except those who benefited from consumer ignorance.

Call to Action for Other States

Atwell urges home inspectors nationwide to advocate for similar legislation. “This isn’t about us,” he says. “It’s about protecting people from buying homes blind.”
