Developments in New and Carried Over Bills

Alaska HB 27 has died with the end of the legislative session in Alaska.

California SB 1332. On May 6th, the Committee on Business and Professions held a public hearing on the bill. At the hearing, the Committee voted to recommend passage of the bill, and to refer SB 1332 back to the Committee on Rules for further action. On May 16th, the Senate passed SB 1332 on a vote of 26-9 and forwarded to the Assembly for further review. On May 28th, the bill was referred to the Assembly Committee on Business and Professions for further review. A hearing has been scheduled for June 18th.

Colorado SB 208. On May 2nd, the House Committee adopted a motion to postpone further action on the bill. The bill is dead.

Maryland HB 868. The bill is dead.

Minnesota HF 3518 HF 3518 died with the end of the legislative session in Minnesota.

Missouri HB 1723 The Missouri session has ended and the bill are dead.

New Jersey New Jersey’s Home Inspection Professional Licensing Act, Chapter 8, Title 45, enacted in 1998, finally went into effect on June 3. During the first 365 days after June 3, any home inspector who meets the licensing requirements and has been engaged in the practice of home inspectors for compensation not less than three years before June 3, 2002 (i.e., June 3, 1999) and performed not less than 300 inspections will be grandfathered.

A 567 A 567 is a licensing bill. The bill amends the existing Home Inspection Professional Licensing Act, by adding three members to the Home Inspection Advisory Committee to include two construction or sub-code officials and one representative of a county college. A 567 requires that as a condition of renewal of a license, an individual shall complete 20 credit hours of continuing education. The Advisory Committee shall establish standards for continuing education and approve programs offering continuing education credits. Under current law, to be eligible for licensure, an individual is required to pass the ASHI examination. A 567 was introduced by Representative Impreveduto on January 8th, and referred to the Assembly Committee on Regulated Professions and Independent Authorities. No further action has been taken. This bill would allow an additional examination to be offered, as long as it is administered or approved by the Advisory Committee. In addition, this bill amends current licensure requirements by allowing an applicant to complete a course of study (including not less than 50 home inspections) offered by county colleges licensed by the New Jersey Commission on Higher Education. A 567 would also allow certain building inspectors, licensed under the Uniform Construction Code Act, to be issued a home inspector license under prescribed circumstances.

A 567 was introduced by Representative Impreveduto on January 8th, and referred to the Assembly Committee on Regulated Professions and Independent Authorities. No further action has been taken.

Oklahoma SB 1277 The bill is dead.

Rhode Island S 2492 S 2492 died with the end of the legislative session in Rhode Island.

South Carolina SB 237 On May 21st, the Committee gave the bill a favorable report and voted to recommend passage as amended. On June 5th, the House adopted the bill as amended and forwarded the bill to the Governor for further action.
